If the deadline for filing an application is missed, the holder of rights loses the exclusive rights to his trademark.
You can renew your trademark as many times as you need. There is no limit to the number of renewals. Each next renewal of the trademark registration is done for 10 years.
The deadline for renewal has passed - what to do?
If the holder of rights missed the deadline for submitting an application, then in order to renew the registration, he must submit a separate application for the restoration of the deadline for filing, this is possible within 6 months. If this is not done, then the holder of rights loses all rights to the trademark.
Can a trademark renewal be refused? Reasons for refusal?
Rospatent may refuse to renew the registration for the following reasons.
- Incorrectly executed trademark application for renewal and or errors in the accompanying documentation.
- If the application is submitted by a proxy of the rightholder, but his powers are not formalized in accordance with the legislation.
- In the absence of a supporting document for payment of the state fee for the extension of the powers of the trademark.
- Revealed similar or identical signs with an earlier priority
- The deadline for the renewal application has not been met.
In all these cases, the Patent Office will refuse to renew the registration of the trademark.
